1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. On query of the Court that as to what happened after the order dated 29.01.2016 was passed by the learned court of Additional District and Sessions Judge-XIV, East Champaran at Motihari in connection with Criminal Revision No.234 of 2015 as the order records that the order of the learned Magistrate was set aside and the matter was remanded to the learned C.J.M. for passing a fresh order strictly in accordance with law, on which the learned counsel for the petitioner submits that he does not have any instruction in the matter.
3. The learned A.P.P. for the State submits that in the event, if the Court interferes with the order impugned passed by the learned Additional District and Sessions Judge-XIV, East
Patna High Court CR. MISC. No.10165 of 2016(2) dt.01-09-2023 2/2 Champaran at Motihari in Criminal Revision No. 234 of 2015 and thereafter it comes to the notice of the Court that already the learned C.J.M. has passed an order in terms of the remand of the case by order dated 29.01.2016 in Criminal Revision No.234 of 2015, the entire effort of this Court would go futile.
4. Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to entertain the quashing application.
5. Accordingly, the quashing application is dismissed. (Satyavrat Verma, J) Rishi/- U T
