JUSTICE ARUN KUMAR ORAL ORDER 19-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Special Case No. 99 of 2017 arising out of Bahadurpur P.S.Case No. 138 of 2017 registered under Sections 324, 353, 401 and 414 of the Indian penal Code and Sections 20 and 22 of N.D.P.S. Act.
It is submitted that on disclosure of the name by co-accused, this petitioner has been apprehended and two mobile sets and one modem were recovered from his possession which belong to him and later on recovery of 04 sachet of smack was inserted in seizure list and the petitioner is in custody since 17.07.2017 and charge sheet has been in this case.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Krishna Kumar @ Chhotu @ Chotu is
Patna High Court Cr.Misc. No.3771 of 2018 (2) dt.19-01-2018 2/2 directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions JudgeIII, Patna in connection with Special Case No. 99 of 2017 arising out of Bahadurpur P.S.Case No. 138 of 2017 with condition that one of the bailor must be his close family relative. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any medical emergency, his bail bond shall be liable to be cancelled.
