JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 04-08-2016 In the present case the challenge is to the order dated 24.9.2012 passed by the learned Chief Judicial Magistrate, Patna whereby he has taken cognizance of the offences punishable under Sections 25(1-B)(a) and 26 of the Arms Act in Pirbahore P.S. Case No.208 of 2012.

2. The petitioner Mr. Arshad Ayub is a named accused in the FIR. According to the prosecution case two revolvers out of which one was loaded was recovered from the room of the petitioner. The seizure list was prepared in presence of two independent witnesses and on completion of investigation, the police submitted charge-sheet pursuant to which cognizance was taken against the

3. Having perused the materials available on record, I see no illegality in the impugned order dated 24.9.2012 passed by the learned Chief Judicial Magistrate, Patna.

4. Accordingly, the application, being devoid of any merit, is dismissed.
