Petitioner seeks regular bail in Madhubani (Town) P.S. Case No.88 of 2016 corresponding to G.R.No.542 of 2016 instituted for the offence under Sections 406/420 of the I.P.C. and section 66(D) of I.T.Act.
Informant, Durgesh Kumar Chaudhary, in his written complaint has stated that on 06.03.2016 while he was trying to check his bank balance but he did not succeeded, unknown boy who was standing behind him took his ATM Card and inserted in the A.T.M.Machine and told the informant to press his Pin number and checked his balance and in course of which the said boy gave him other A.T.M.Card and subsequently he got information that
Patna High Court Cr.Misc. No.2221 of 2018 (3) dt.08-02-2018 2/2 Rs.10,000/- has been withdrawn from his account. The informant has alleged that he received information that Rs.10,000/- was transferred in the Account of Kanchan Kumar.
It has been submitted by the petitioner that he is innocent and no offence has been committed by him and he has been remanded in this case from Jhanjharpur P.S. Case No.95 of 2017. He is in custody since 10.11.2017.
Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Madhubani, in Madhubani (Town) P.S.Case No.88 of 2016 corresponding to G.R.No.542 of 2016.
