Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in Alamnagar P.S. Case No. 141 of 2015, registered for the offences punishable under Sections 341, 323, 504, 506, 406 and 34 of the Indian Penal Code.

It is alleged that co-accused Bipin Thakur and Khudbudi Thakur @ Shushil Thakur being the Munshi and Contractor got the work of construction of a Godown done by

Patna High Court CR. MISC. No.11031 of 2020(2) dt.16-06-2020 2/3 the complainant and eleven labourers in two months, but they did not pay their wages. When the complainant along with others went at the house of co-accused Bipin Thakur and demanded their wages, then these petitioners abused and assaulted them with slaps.

It is submitted that petitioners have falsely been implicated in this case. Entire allegation is false and concocted. There is delay of three months in lodging of FIR. After investigation, the police did not find case true against these petitioners, but the learned court below differing with the same took cognizance against these petitioners under Section 323, 341, 406, 420, 504, 506 and 34 of the Indian Penal Code. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Udakishunganj, Madhepura in connection with Alamnagar P.S. Case No. 141 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of
