NILU AGRAWAL ORAL ORDER 28-07-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner is languishing in jail since 10.04.2017 in a case registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.

The prosecution case as lodged by the father of the victim girl Ragini Kumari is that while they were away from the house and the victim girl in the house, the petitioner along with family members came and kidnapped the victim girl in Scorpio car.

Learned counsel for the petitioner submits that he is innocent, bears no criminal antecedent and the victim girl and the petitioner are now as husband and wife as per Hindu rites and

Patna High Court Cr.Misc. No.27807 of 2017 (3) dt.28-07-2017 2/2 customs and the victim girl is living with her matrimonial house. Learned counsel for the informant also does not oppose the said contention.

Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- ( Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned I/C Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S.Case No. 101/ 2016.
