ANJANA PRAKASH ORAL ORDER 22-04-2015 The Petitioner was granted anticipatory bail by order dated 29.1.2015 vide Cr.Misc.No.3804 of 2015 but on condition that he would file an affidavit that he is not an accused in any other case.
Since the Petitioner was an accused in one other case, which was inadvertently not mentioned in Paragraph 3 of the petition, he could not be released on anticipatory bail. However, since a second anticipatory bail application is not maintainable, I am not inclined to entertain this application. The same is disposed of with liberty to the Petitioner to appear before the court concerned, who shall also consider the fact that the Petitioner is a lady and she has been granted anticipatory bail on merits by this Court.
