JUSTICE ARUN KUMAR ORAL ORDER 30-01-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Harshidhi P.S.Case No. 429 of 2016 G.R. No. 6654 of 2016 registered under Sections 272 and 273 of Indian Penal Code and Sections 30, 36 ,37(a) and 38 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that in total 193 liters of foreign liquor was recovered from the house of one Paltu Sah and has been admitted to bail by a co-ordinate Bench of this Court vide order dated 25.08.2017 passed in Cr. Misc. No. 40951 of 2017 and petitioners are not family members of Paltu Sah and are in custody since 20.11.2017.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.3125 of 2018 (2) dt.30-01-2018 2/2 the petitioners, namely, Uday Singh and Chandan Singh are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-VII-cum-Special Judge, East Champaran, Motihar in connection with Harshidhi P.S.Case No. 429 of 2016.
