This is an application for bail in connection with Kahalgaon (Ghogha) P.S.Case No. 183 of 2017 registered for the offences punishable under Sections 302, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is order-giver and on his order co-accused fired shot at the deceased causing his death. It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case because he has deposed against father of the informant in a murder case in which father of the informant has been convicted and he is in custody for more than two months.

Patna High Court Cr.Misc. No.29573 of 2017 (3) dt.25-07-2017 2/2 Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected at this stage. However, petitioner may renew his prayer for bail after framing of charge or after completion of three months in custody from today, whichever is earlier.
