2. The petitioner has preferred this application for grant of regular bail in connection with Udwantnagar P.S. Case No. 131 of 2024 dated 02.04.2024 registered for the offences punishable u/s 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, On 02.04.2024 at about 6 A.M., the informant along with her family members was harvesting crops in her agricultural field, in the meantime, the petitioner along with eleven others named accused persons came and formed an unlawful assembly. On being instigated by the co-accused Tez Bahadur Yadav and Bir Bahadur Yadav, all the

No.12710 of 2025(3) dt.07-08-2025 2/3 accused persons started firing indiscriminately upon the informant and her family members but somehow they tried to save their lives due to which Ramdhar Yadav (Father-in-law) was shot in the head and Mukesh Yadav (Brother-in-law) was shot at the back and fell near the canal and both succumbed to their injuries.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The co-accused persons have already been granted regular bail by this court vide order dated 24.02.2025 passed in Cr. Misc. No. 2311/2025. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 02.11.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
