JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 25-01-2016 The present writ petition has been filed for quashing the order contained in Memo No. R B B/Muz/46/208 dated 07.11.2013 issued under the signature of the Manager, Allahabad Bank, Branch Muzaffarpur whereby and whereunder he directed the petitioner to deposit the total instalment dues of amount of Rs.20,00,000/- which was sanctioned by the Allahabad Bank, with interest on total dues within 15 days.
2. Learned counsel for the petitioner submits that the petitioner is ready to repay the loan amount but however, some time may be granted for making payment of the entire dues in instalments.
3. Learned counsel for the respondent-Bank, on the other hand, refers to the sanction order of the Bank dated 17.07.2012
Patna High Court CWJC No.7254 of 2014 dt.25-01-2016 2/2 which itself contemplates 180 monthly instalment of Rs. 25,000/- commencing from the month of August 2013. It is, therefore, submitted that instalments have already been provided but the petitioner has merely paid two amounts of Rs. 5,000/- and Rs.20,000/- respectively and that too as far back as in the months of November and December, 2013.
4. In the above view of the matter, this Court does not find any merit in the writ petition, which stands dismissed. (Vikash Jain, J) B.T/- U
