Petitioner seeks bail in a case registered under Sections 447, 341, 323, 325, 504, 436, 379/34 of Indian Penal Code.
Submission is made on behalf of the petitioner that the allegations against the petitioner are general and omnibus alongwith 14 other persons. He submits that he is innocent and has committed no offence. The instant prosecution is outcome of land dispute between the parties and that all the sections are bailable except Sections 379 and 436 of IPC, allegations in respect of the said two sections have specifically been levelled against the
Patna High Court Cr.Misc. No.28796 of 2017 (2) dt.01-07-2017 2/2 other co-accused persons and not against the petitioner. Further submission is that there is case and counter case between the parties. Petitioner has also annexed the injury reports of the alleged injured persons of the instant FIR, namely, Abdul Razzak and Zainab Khatoon and submitted that from perusal of the same, it is apparent that the injuries sustained by them are simple in nature.
Considering the aforesaid submissions, the petitioner is directed to be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in Srinagar Police Station Case No 35 of 2017.
