Case No. 368 of 2021, registered for the offence punishable punishable under Section 30(a)/41 of the Bihar Prohibition and Excise Act, 2016.

425 liters of illicit liquor has been recovered from Alang near Devi Asthan which is said to have been hidden by the petitioner and his associates.

It is submitted that no recovery has been made from conscious possession of this petitioner or from his house. Recovery has been made from open place which is accessible to general public. Petitioner is in custody since 07.10.2021. Investigation is complete.

Learned counsel appearing for the State opposes the prayer for bail. He submits that the petitioner has got identical

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. However, once charge is framed and trial commences, the petitioner, shall be released on bail by the trial court to its own satisfaction on the condition that the petitioner will co-operate in the trial.
