The petitioner seeks bail in Ghorasahan P.S. Case No. 226 of 2016 registered under Section 392 of the Indian Penal Code.

Four motorcycle borne criminals are said to have looted the informant on the point of gun and fled away taking his motorcycle and cash of Rs. 5,000/-. A motorcycle was recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the motorcycle which was recovered from his possession was hailing to his father and the same was released in favour of his

Patna High Court Cr.Misc. No.28968 of 2017 (2) dt.03-07-2017 2/2 father by the Court below. Nothing incriminating article has been recovered from the conscious physical possession of the petitioner. The allegation levelled against the petitioner is general and omnibus in nature. He is not named in the F.I.R. He has been languishing in custody since 19.03.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sikarahana at Dhaka, East Champaran in connection with Ghorasahan P.S. Case No. 226 of 2016.
