Petitioner, already in custody, seeks bail in connection with Dulhin Bazar P.S. Case No.178 of 2014, registered under Sections 147, 148, 149, 323, 341 and 302/34 of the Indian Penal Code.
Allegation in brief is that the son of the informant was assaulted by 20 persons.
Learned counsel for the petitioner submits that there is general and omnibus allegation against 20 persons of assaulting the son of the informant but she is not an eye-witness, according to the post-mortem report some bruises and some fracture over parietal region were found, the petitioner seeks bail on the ground of parity as similarly situated co-accused, namely, Kaltar
Patna High Court Cr.Misc. No.15622 of 2018(2) dt.19-03-2018 2/2 Paswan and Kangresh Saw were granted bail by another coordinate Bench as well as by this Court also by orders dated 13.10.2015 and 13.02.2018, passed in Cr. Misc. Nos.31590 of 2015 and 8666 of 2018 respectively. It is also submitted that the deceased was a man of criminal background and this petitioner has no criminal antecedent.
Having considered the aforesaid facts and circumstance, petitioner Sahejiya Sao is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III, Danapur, District Patna in connection with Dulhin Bazar P.S. Case No.178 of 2014.
