The petitioner seeks bail in connection with Bakhtiarpur P.S. Case No. 84 of 2017, registered under Section 7 of the Essential Commodities Act.
The accusation is that on receiving secret informant about carrying of government rice from a tractor for black marketing. Block Supply Inspector along with Police officials reached at Kumedantola and saw that villagers have stopped the tractor attached with trailer. On search, 25-30 bag of rice were found on the said bag RRC and RRA was printed. On enquiry, the tractor driver disclosed his name as Sanjay Kumar Bhagat (Petitioner) and he further disclosed that the tractor was hired by his villager Awdhesh Bhagat.

No.27691 of 2017 (2) dt.12-07-2017 2/2 Learned counsel for the petitioner submits that it would appear from the F.I.R. that the tractor of the petitioner was hired by his villager Awdhesh Bhagat and he had no concerned about the loaded rice. The petitioner has no criminal antecedent is in custody since 11.04.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Saharsa in connection with Bakhtiarpur P.S. Case No. 84 of 2017. (Rajendra Kumar Mishra, J) manish/- U T
