The petitioner is apprehending his arrest in connection with Patahi P.s.Case no.124/2018 dated 17.6.2018 registered for offences punishable under Sections 341, 342, 324, 307, 326, 506/34 of the Indian Penal Code.

Allegation as per FIR is that the petitioner and other accused persons caught hold to the injured and Vishal Paswan stabbed him on the abdomen due to which his intestine came out.

Submission of the learned counsel for the petitioner is that there is no allegation of assault against the petitioner and he has been falsely implicated in this cae.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record and if possible to be disposed of on the same day. With the aforesaid direction, this application is disposed of.
