The petitioner seeks anticipatory bail in connection with Complaint Case No. 302 of 2013 registered under Sections 420, 406, 468, 469 and 120B of the Indian Penal Code.

It is contended that the entire allegations made in the complaint are false and for the same set of facts an FIR bearing Khagaria (Chitragupt Nagar) P.S.Case No. 120 of 2013 was lodged by the uncle of the petitioner, Surendra Prasad Singh in which complainant and others have been made accused. In that case, on the basis of the confession made by the complainant of the present case, the petitioner has been subsequently impleaded as an accused. It is further submitted that the present case is in the nature of counter case and has been instituted just in order to put pressure upon uncle of the

Patna High Court Cr.Misc. No.10198 of 2015 (3) dt.30-07-2015 2/2 petitioner to execute the deed in favour of the complainant. On the other hand, learned counsel for the complainant has vehemently opposed the prayer for bail. He has submitted that the petitioner in connivance with Jai Jai Ram Singh @ Ladho Singh @ Angad Singh and Tenish Kumar @ Chunnu has cheated the complainant to the tune of Rs.75,000/-.

It would appear from the record that co-accused Tenish Kumar @ Chunnu and Jai Jai Ram Singh @ Ladho Singh @ Angad Singh have already been granted anticipatory bail vide order dated 19.04.2014 passed in Cr. Misc. No. 9147 of 2014 and order dated 06.02.2015 passed in Cr. Misc. No. 32934 of 2014 respectively. Regard being had to the facts and circumstance of the case, in the event of arrest or surrender within a period of four weeks from today, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria in connection with Complaint Case No. 302 of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
