Petitioner seeks bail in a case registered for the offences punishable under Sections 447, 448, 341, 323 & 307/34 of the Indian Penal Code and 27 of Arms Act. On the same day, occurrence of firing took place from both sides. The petitioner also sustained firearm injury in his stomach which would be evident from perusal of the FIR of Karpi P.S.Case No.81 of 2017 dated 27.04.2017 lodged by the wife of this petitioner.
Allegation against the petitioner is that he also caused firearm injury at the chest of the informant of this case.
The petitioner is in custody since
Patna High Court Cr.Misc. No.7565 of 2018 (3) dt.14-03-2018 19.06.2017.
Earlier prayer for bail was refused by a Coordinate Bench of this Court in Cr.Misc.No. 48511 of 2017 vide Annexure-1.
Considering the case and counter case and injury sustained by the petitioner as well as period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Karpi Police Station Case No.82 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
