This application for regular bail arises out of Yogapatti (Sanichari) P.S. Case No. 152 of 2019, disclosing offence under Sections 302/34 of the Indian Penal Code. The petitioner is the husband of the deceased. The marriage between them were solemnized nearly eight years before the deceased died. There is allegation in the First Information Report of demand of dowry against the petitioner and their family members. It is alleged in the FIR that because the informant failed to satisfy the demand of dowry, the accused persons killed the deceased.

Learned counsel appearing on behalf of the petitioner has submitted that except for the vague allegation that the

No.12983 of 2020(2) dt.03-03-2020 2/2 deceased was killed by the persons named in the FIR, there is absolutely no material against the petitioner, which can be said to be constituting an offence punishable under Section 302 of the Indian Penal Code. She contends that the petitioner is in custody since 16.05.2019.

Considering the nature of allegation in the FIR, in my opinion, a case for grant of regular bail is made out. This application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah in Yogapatti (Sanichari) P.S.
