The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a woman and is a person with clean antecedent and from perusal of the allegations as alleged in the FIR, it would manifest that no specific allegation has been alleged against the petitioner though it is alleged that Bipin Das gave orders to assault the informant, thereafter, Ashok Das assaulted the informant with lathi on his head and when the family members of the informant came to save him it is alleged that all the accused persons assaulted them. It is next submitted that the

Patna High Court CR. MISC. No.17015 of 2023(2) dt.25-05-2023 2/2 petitioner being wife of Ashok Das, has been falsely implicated. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Balia P.S. Case No. 245 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
