The petitioner is apprehending his arrest in connection with Bakhri P.S.Case no.262 of 2018 , registered for offences punishable under Sections 366, 372 and 373 of the Indian Penal Code.

Allegation against the petitioner as per FIR is that the police got information that one minor girl was kept in the village Nadail for immoral trafficking, on that the police reached at the house of Indu Devi and recovered the girl Putul Kumari, who disclosed that she fled away from Lalu Rai for marriage but Lalu Rai cheated her and thereafter she came tin the contact of Surendra Rai in orchestra and remained there for two months and then she again fled away to another house Orchestra and later on she came in contact with the wife of the petitioner and she was invited there and she was residing there.

Patna High Court CR. MISC. No.12787 of 2019(3) dt.30-04-2019 2/2 Submission of the learned counsel for the petitioner is that the petitioner has been made accused only he is husband of Indu Devi and there is no allegation against the petitioner and he has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Smt. Sangita Rani, Sub Judge III-cum-ACJM-V, Begusarai in connection with Bakhri P.S.Case No.262 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with condition hat he will co-operate in the investigation otherwise his bail bond shall be cancelled.

With the aforesaid direction, this application is allowed.
