The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 8 litres of country made liquor has been recovered from the Bhagirathi Mandir and the petitioner has been made accused on the confessional statement of co-accused Vijay Yadav. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail petition.
However, petitioner is agreed to deposit Rs. 5,000/- in the Juvenile Justice Fund of the State Social Welfare

In the facts and circumstances of the case, on deposit of the aforesaid amount, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge Excise, Gopalganj in connection with Mirganj Police Station Case No. 323 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
