JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 03-04-2019 The petitioner is aggrieved by the fact that despite recommendation by the concerned department for grant of second ACP as well as MACP to him, the same has been denied to him till date.

2. It has been submitted on behalf of the petitioner that he had joined on the post of Welfare Supervisor on 21.09.1982 in the Social Welfare Department.

Patna High Court CWJC No.5216 of 2019 dt.03-04-2019 2/3 After several years of rendering effective service, the petitioner was promoted to the post of Block Welfare Officer on 30.06.2004. Since his promotion to the post of Block Welfare Officer in 2004, the petitioner has been serving the Welfare Department continuously. Despite recommendation of the department for payment of second ACP and MACP to the petitioner, as has been noted earlier, the same is being denied to him. Several representations filed by the petitioner before various authorities have yielded no result.

3. Under the aforesaid circumstances, this Court deems it appropriate to direct the petitioner to make a fresh representation, detailing his grievances before the Director, SC & ST, Welfare Department, Bihar, Patna (respondent No.

4) within a period of four weeks from today, who, on receipt of such representation and after verifying the records, shall pass a reasoned order within a period of four weeks thereafter.

4. If the claim of the petitioner is found to be tenable, necessary/sequel order shall be passed forthwith i.e. within time frame stipulated in the present order.
