Mr.Rina Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-03-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

Allegation against the petitioner is of committing torture upon the victim for non-fulfillment of demand of dowry. Learned counsel for the petitioners submits that the petitioners are in laws and there is no specific allegation against the petitioners. He submits that the husband of the deceased namely Sonu Ram has already been surrendered before the court below on 20.11.2019 and since then he is in judicial custody. He further submits that petitioners bear no criminal antecedent.

Patna High Court CR. MISC. No.11087 of 2020(2) dt.04-03-2020 2/2 Learned counsel for the informant submits that petitioners along with his son has committed the said crime and the postmortem report shows that cause of death is due to asphyxia hanging by ligature.

In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Judge-IX-cum-A.C.J.M., Patna in connection with Gopalpur Police Station Case No. 324 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
