The petitioners, six in number, apprehend their arrest in a case under Section 323 and other sections of the Indian Penal Code and Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Learned counsel for the petitioners submits that he may be permitted to withdraw the Anticipatory Bail Petition filed on behalf of the petitioners no. 3, 4, 5 and 6. Permission is allowed.
The Anticipatory Bail Petition of the petitioners no. 3, 4, 5 and 6, namely, Rakesh Yadav, Ankaj Yadav, Kaila Yadav
Patna High Court Cr.Misc. No.8407 of 2015 (2) dt.02-03-2015 2/2 and Rakesh Yadav is dismissed as withdrawn.
So far as the case of the petitioners no. 1 and 2, namely, Shobha Devi ad Rekha Devi are concerned, there is no specific allegation against them of abusing the informant and his family members.
Considering the fact aforesaid, the above named petitioners no. 1 and 2, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Munger in G.R. No. 1584/14, arising out of S.C. & S.T. P.S. Case No. 15/14, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
