Counsel for the petitioner submits that though he has been serving department of Public Health (Mechanical) Division, Bhagalpur since 18.05.1982. He has been discriminated in the matter of regularization. Person who had been engaged after him have been regularized ignoring his claim.
Counsel for the State, on the other hand, raises issue regarding maintainability of the instant proceeding. Referring to annexure 9 it is submitted that earlier writ petition filed by the petitioner for the same relief was withdrawn.
Patna High Court CWJC No.4630 of 2016(2) dt.19-06-2019 2/2 Faced with the said difficulty, counsel for the petitioner seeks liberty to prefer intra court appeal against the order dated 20.06.2014 passed in earlier writ proceedings being CWJC no.2400/2014.
In view of such liberty sought for by the petitioner, no further order is required to be passed in this case. Petitioner would be at liberty to proceed in accordance with law. Writ petition is disposed of.
