The petitioner seeks bail in connection with Amnour P.S. Case no. 146 of 2017 registered under Sections 188, 272, 273, 420, 120(B) of the Indian Penal Code and Sections 30 (a), 38, & 41 of the Bihar Excise and Prohibition Act 2016. 1973.520 lts. of foreign liquor is said to have been recovered from Bolero vehicle and its driver namely, Bachcha Rai was apprehended, who divulged that 15 accused persons including the petitioner managed to escape.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. Petitioner has no concern either with the
Patna High Court Cr.Misc. No.8623 of 2018(2) dt.17-02-2018 2/2 aforesaid vehicle or with the seized liquor or any business of the liquor. There is nothing in the record indicating the complicity of the petitioner in the occurrence barring the statement of coaccused Bachcha Rai. He has no criminal antecedent. He has been languishing in custody since 30.11.2017. Similarly situated co-accused namely, Tarkeshwar Singh has been enlarged on bail vide order dated 12.12.2017 passed in Cr. Misc. no. 57429 of 2017 by a co-ordinate Bench of this Court. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ- VIth Saran at Chapra in connection with Amnour P.S. Case no. 146 of 2017.
