In this case, the petitioner is seeking regular bail in connection with Govindganj P.S. Case No. 288 of 2022, registered for the offences punishable under Sections 363, 365, 366, 366(A) of the Indian Penal Code and 8 of the POCSO Act. As per allegation, the daughter of the informant went with co-accused Raushani Khatoon, when she did not return the family members conducted search and during search the petitioner apprised him that his daughter has been kidnapped. Later on, the informant came to know that coaccused Sarik Ansari, after forcibly got the victim seated on his motorcycle, kidnapped her.

No.13519 of 2023(2) dt.20-04-2023 2/3 The learned counsel for the petitioner has submitted that there is no allegation against the petitioner of kidnapping the minor daughter of the informant. Co-accused Sarik Ansari has been granted bail in Cr. Misc. No. 55884 of 2022, by a learned coordinate Bench. The petitioner is a lady of clean antecedent and she is under custody since 23.01.2023. On the other hand, the learned counsel for the informant has opposed the prayer for bail and has submitted that the petitioner is named in the FIR and she was aware with the entire facts.
Considering the above-mentioned facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge cum Special Judge, POCSO Act, East Champaran at Motihari in connection with Govindganj P.S. Case No. 288 of 2022.
This case was taken up out of turn for the hearing on the basis of mentioning slip filed on behalf of the petitioner annexed with invitation card, with a prayer that her marriage has been fixed with one Vikas Kumar and marriage is scheduled to be held on 08.05.2023.
Patna High Court CR. MISC. No.13519 of 2023(2) dt.20-04-2023 3/3 The Superintendent of Police, East Champaran is directed to inquire into the matter and report within four weeks. The office is directed to send a letter in this respect to the Superintendent of Police, East Champaran annexing the xerox copy of mentioning slip as well as invitation card annexed therewith.
