JUSTICE ARUN KUMAR ORAL ORDER 08-02-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seek bail in Jhajha PS Case No. 246 of 2017 registered under Sections 121, 121A, 120B of the IPC Sections 16, 17, 18, 19, 20, 21 and 22 of U.A.P.Act and 3⁄4 of the Explosive Substances Act.

The allegation in brief is that the police on getting secret information about assembly of Naxalite raided forest area and apprehended four persons including the petitioners and from the possession of petitioner No. 1 two detonators were recovered and on their disclosure in all 45 KG of explosive was recovered. Learned Counsel for the petitioners submits that the petitioners run grocery shop and there is no specific allegation as to who disclosed information leading to recovery, It is submitted that the petitioners are in custody since 23.8.2017 and have clean antecedent.

Having considered the said facts and circumstances, the petitioners, namely, Bisheshwar Modi and Ranjeet Modi are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by both of them with two sureties of the like amount each

Patna High Court Cr.Misc. No.7902 of 2018 (2) dt.08-02-2018 to the satisfaction of SDJM Jamui in connection with Jhajha PS Case No. 246 of 2017, subject to verification of their criminal antecedent and if criminal antecedents are found against them they shall not be released.
