The petitioner seeks bail in Jalalpur P.S. Case No. 108 of 2015 registered under Section 420, 308, 272 and 273/34 of the Indian Penal Code and Section 47 (a) of the Bihar Excise Act.

114 liters of country made liquor is said to have been recovered from the half constructed 'Bathan' of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. Petitioner has no concern with the seized liquor. He was not apprehended on the

Patna High Court Cr.Misc. No.8346 of 2018 (02) dt.16-02-2018 2/ 2 spot. The place of occurrence is open and not bounded and is also accessible to anyone. He has been falsely implicated in this case due to dirty village politics. He has no criminal antecedent. He has been languishing in custody since 22.12.2017. . In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. VI, Saran at Chapra in connection with Jalalpur P.S. Case No.108 of 2017. (Prakash Chandra Jaiswal, J) Trivedi/- U
