JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-03-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Shankarpur P.S. Case No. 54 of 2015 for offences under Sections 341, 323, 363, 365, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent and they are husband and wife.

The allegation against the petitioners is that they were involved in kidnapping the son of the informant for the purpose of marriage with daughter of the petitioner.

Learned counsel for the petitioners submit that the

Patna High Court CR. MISC. No.11584 of 2020(2) dt.04-03-2020 2/2 parties have settled their dispute and son of the informant and daughter of the petitioner have joined wedlock at different places.

Considering the totality of the facts and circumstances of the case, this Court is inclined to grant bail to the petitioners. Let petitioners, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Madhepura in connection with Shankarpur P.S. Case No. 54 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) BT/- U T
