JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 27-08-2015 The petitioner challenges order of the SDO, Sadar Saharsa, dated 9.5.2013, cancelling his PDS License no.320/2009 on the ground that the SDO while relying on an enquiry report, without its service to him, cancelled his license stating that the show cause is not satisfactory. Counter affidavit has been filed by the State enclosing the enquiry report, a copy of which has already been served to the counsel appearing for the petitioner.

As the submission of the petitioner has substance, the impugned order is set aside and the matter is remanded to the SDO for passing fresh order within four months from the date of receipt of this order, after considering the reply of the petitioner filed by him afresh.
