Petitioner seeks bail in a case registered for the offences punishable under Sections 394,302 of the Indian Penal Code and 27 of Arms Act.

The FIR of the occurrence of murder of the brother of informant is against unknown.

Submission is that during investigation, the petitioner was arrested on suspicion and thereafter his confession was recorded before the police that much is material against the petitioner. Though the confession before the police is no evidence in spite of that the learned court below has refused the prayer for bail.

Finding substance in the aforesaid submission, let

Patna High Court Cr.Misc. No.18148 of 2018 (2) dt.03-04-2018 the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Town Police Station Case No.215 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
