The petitioner is apprehending his arrest in a case registered under Sections 8, 9, 14 of the Protection of Children from Sexual Offences Act, 2012.
Allegation is that the petitioner outraged the modesty of the informant and her two sisters.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The complaint case was filed after three months of the alleged occurrence vide Annexure 2 to the present application. The complaint petition was sent to the concerned Police Station under Section 156(3) Cr.P.C. and thereafter the
Patna High Court CR. MISC. No.12412 of 2019(2) dt.01-03-2019 2/2 present F.I.R. was lodged. The complainant/informant has retracted from her earlier statement made in the complaint case. On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, West Champaran at Bettiah in connection with Chanpatia P.S. case No.397 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
