Petitioner seeks bail in Bihiya (Bahoranpur) P.S. Case No.422 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant (S.H.O. of Bahoranpur O.P.) got information that Raj Kumar Singh had kept huge quantity of liquor in his latrine near the western side of his house and on such, a raid was conducted. A huge quantity of Indian made foreign liquor weighing about 397 litres was recovered. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.16197 of 2020(2) dt.14-05-2020 2/2 petitioner is the father of Raj Kumar Singh. There is no allegation that the petitioner had kept the liquor in his latrine. The allegation is against Raj Kumar Singh (son of the petitioner) who has already been enlarged on bail vide order dated 16.01.2020 passed in Cr.Misc.No.77022 of 2019 by a coordinate Bench of this court.

Learned A.P.P. did not dispute the facts.

Considering the facts aforesaid and the fact that Raj Kumar Singh against whom the allegation is made for storing liquor in his latrine has already been enlarged on bail and the petitioner is the father of Raj Kumar Singh, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned 4th A.D.J.-cumSpecial Judge, Excise, Bhojpur at Ara in connection with Excise Case No.1800 of 2018 arising out of Bihiya (Bahoranpur) P.S. Case No.422 of 2018.
