The petitioner, who is in custody, seeks bail in connection with Jogbani P.S. Case No. 195 of 2017 registered for the offence punishable under Sections 386, 307, 504, 506 of the Indian Penal Code and Sections 3/4/5 of Explosive Substance Act. Further Section 120B of the Indian Penal Code was added.

Informant is the shop keeper, who has alleged that between 18.09.2017-20.09.2017 he received a mobile call between 3 to 4 PM who disclosed his name as Rajjak and started demanding ransom of Rs. 5 lacs and if same is not paid to him informant will be killed. The informant has alleged in the

Patna High Court Cr.Misc. No.15665 of 2018(3) dt.12-04-2018 2/2 FIR that he came to know that the brother in law of Razzak namely Rahmat was calling by the aforesaid mobile and one Dharmanath Giri in respect of demand of ransom. The name of petitioner surfaced in this case on the basis of confession made by Rina Khatoon and his self confession, except that, there is no incriminating material against the petitioner. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 04.12.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Jogbani P.S. Case No. 195 of 2017.
