2. The petitioners apprehend arrest in connection with Chouri P.S. Case No. 62 of 2023 dated 04.07.2023 instituted for the offence punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.
3. The allegation against the accused persons including the petitioners is that they abused and assaulted the informant with lathi and danda. It is alleged that petitioner no. 1, Manu Singh and co-accused Sonu Kumar @ Sonu Singh made firing with their pistol and rifle. When the Bhaisur of the informant, namely, Dhananjay Singh came to rescue her, he was also assaulted by
Patna High Court CR. MISC. No.16963 of 2025(2) dt.19-03-2025 2/3 petitioner nos. 2 & 3 causing injuries on his head, palm and chest.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is further submitted that the present F.I.R. is counter blast of Chauri P.S. Case No. 58 of 2023 lodged by Santosh Singh, who is one of the co-accused in the present F.I.R. Learned counsel for the petitioners further submits that after investigation, police submitted final form against the petitioners, but the Magistrate took cognizance against all the accused persons. It is further submitted that both the sides are agnates. Due to land dispute between the parties, one Vinay Pratap Singh filed Title Suit No. 267 of 2023 against the informant, who is defendant in that case. Learned counsel for the petitioners further submits that nothing has been recovered from the conscious possession of the petitioner or from the place of occurrence. No empty cartridges were also found from the place of occurrence. Lastly, it has been submitted that petitioners have no criminal antecedents.
5. On the other hand, learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioners.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with Chouri P.S. Case No. 62 of
Patna High Court CR. MISC. No.16963 of 2025(2) dt.19-03-2025 3/3 2023, they will be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara subject to condition as laid down under Section 438(2) of the Cr.P.C.
