This application in respect of the petitioner no.2, above named, is dismissed as withdrawn.
Now, only the prayer of the petitioner no.1 for grant of anticipatory bail is being considered.
Heard learned counsel for the petitioner no.1 and the learned A.P.P. for the State.
The petitioner no.1 apprehend her arrest in connection
Patna High Court Cr.Misc. No.9663 of 2016 (2) dt.12-04-2016 2/2 with Hathauri P.S. Case No.100 of 2015 registered under Sections 304(B) and 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant by her husband, Gotani and father-in-law for non fulfillment of the dowry demand and to dispose of her dead body. Learned counsel appearing on behalf of the petitioner no.1 submits that the petitioner no.1 is the Gotani of the daughter of the informant, who used to reside separate with the husband of the daughter of the informant but due to ulterior motive, she has been made accused in this case.
Having considered the facts and the circumstances of the case, let the petitioner no.1, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistratecum-Sub Judge-X, Muzaffarpur, in connection with Hathauri P.S. Case No.100 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
