Petitioner, in the present case, is seeking regular bail in connection with Karai Parshurai P.S. Case No. 138 of 2020 registered for the offences punishable under Section 147/148/ 149 / 341/ 323/ 504/ 506/ 307/ 120(B)/ 114/ 115/ 332/ 333/ 353/ 356/ 379/ 336/ 337/ 338/ 143/ 145/ 427/ 150/ 151/ 152/ 109 of the Indian Penal Code. He is in custody since 12.01.2021.
Learned counsel for the petitioner submits that the petitioner has been made accused amongst 22 named and 150 unnamed accused in the First Information Report who had allegedly assembled near the dead body of a boy aged about five years and had
Patna High Court CR. MISC. No.22643 of 2021(2) dt.19-08-2021 2/2 indulged in quarrel with the police party in course of protest. The petitioner has otherwise no criminal antecedent. Learned A.P.P. for the State has though opposed the prayer for regular bail of the petitioner.
Considering the facts and circumstances of the case, there being no specific allegation against the petitioner, petitioner is in custody in connection with this case since 12.01.2021 having no criminal antecedent, this Court directs release of the petitioner above named on bail on furnishing of bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hilsa, Nalanda in connection with Karai Parshurai Case No. 138 of 2020, subject to condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the abovementioned order shall not be delayed for purpose of or in the name of verification.
