JUSTICE BIRENDRA KUMAR ORAL ORDER 08-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with U.A.P Case No.86/2015, arising out of Jhajha P.S. Case No.123 of 2015, a case under Sections 16, 17, 18, 19, 20, 21 and 22 of U.A.P. Act. The police got information that some Naxals are going to assemble at the referred place. When the police reached, one of the co-accused was apprehended and two fled away. The petitioner was the person, who fled away from there. Only pamphlets etc. were recovered from there and nothing incriminating or material of offence was found. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/-

Patna High Court Cr.Misc. No.7850 of 2018 (2) dt.08-02-2018 2/2 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
