The petitioner is in custody in connection with Pandaul P.S. Case No. 14 of 2017 for the offences under Section 272, 273, 34 of the Indian Penal Code and Sections 30(a), 36/38(2) of the Excise Act.
The petitioner is in custody since 5.2.2017. The allegation against the petitioner is that he is engaged in business of liquor. But there is denial of the same on behalf of the petitioner. The petitioner has stated on affidavit in para-3 of the petition that he has no criminal antecedent.
It appears from the order dated 8.6.2017 passed in Cr. Misc. No. 25498 of 2017 that co-accused Parikkshan Sah @
Patna High Court Cr.Misc. No.27258 of 2017 (2) dt.01-07-2017 2/2 Parikshan Gupta @ Parikshan Sah was granted bail. The case of the petitioner appears to be similar to that of said Parikshan Gupta who has been granted bail In view of the facts and circumstances discussed above and the fact that the petitioner is in custody since 5.2.2017, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II, Madhubani or the successor Court in connection with Pandaul P.S. Case No. 14 of 2017, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, influence the witnesses.
