Petitioner seeks bail in a case registered for the offences punishable under Sections 8,20,21,22 of the N.D.P.S.Act.

Two hundred Gm. of Ganja was allegedly recovered from a Gumti. Allegation is that the same was of the petitioner.

Submission is that the recovered quantity is small quantity. The same was not recovered from physical possession of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent. Petitioner is in custody since 29.11.2017. Co-accused Ram Lakhan Rai has already been allowed bail by this Court in Cr.Misc.No.8791

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with N.D.P.S. Police Station Case No.20 of 2017, Reg. No.23 of 2017, arising out of Bakhri P.S.Case No. 300 of 2017, subject to the condition that the petitioner shall fully cooperate with trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
