The petitioner apprehends his arrest in a case registered under Section 307 and other sections of the Indian Penal Code.
The allegation against the petitioner is that while the informant forbade the petitioner from gambling, the petitioner and his father came; the petitioner caught hold of the informant and the father of the petitioner caused sickle injury in the abdomen of the informant.
It is submitted that no injury was found in the abdomen of the informant but from the perusal of the order of the learned Sessions Judge, it appears that a sharp-edged weapon injury was found in the abdomen of the informant and the informant became unconscious.
Patna High Court Cr.Misc. No.6790 of 2015 (2) dt.19-02-2015 2/2 Considering the fact that the petitioner caught hold of the informant and thereafter his father caused a sharp-edged weapon injury in the abdomen of the informant, I am not inclined to enlarge the petitioner on anticipatory bail in Kotwa P.S. Case No. 196/2012. Accordingly, the same is rejected. The petitioner is directed to surrender in the court below within four weeks from today and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner without being prejudiced by this order. (Prabhat Kumar Jha, J) Dilip/- U T
