KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 395 of the Indian Penal Code.
It has been submitted on behalf of petitioner that there is allegation of committing dacoity by the petitioner along with other accused persons in the house of the informant. Petitioner has got no criminal antecedent. Only on the basis of suspicion he has been made accused in the present case. No T.I.P. has been held in the present case nor anything has been recovered from his possession. Similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court vide Cr. Misc. no. 9703 of 2017. Petitioner is languishing in jail custody since 20.03.2017. Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.28982 of 2017 (2) dt.06-07-2017 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi, in connection with Nanpur P.S. Case no. 219 of 2016.
