JUSTICE ARUN KUMAR ORAL ORDER 21-03-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seek bail in Sahebganj PS Case No. 302 of 2017 registered under Sections 147, 148, 149, 341, 342, 323, 324, 325, 307, 302, 504 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that due to land dispute the occurrence took place, Suresh Singh, Ram Sakal Singh and Sahi Singh assaulted Vijay Singh causing his death, thereafter Birendra Singh (petitioner No. 2) is said to have assaulted Ram Babu Singh with farsa causing injury on his hand.

It is submitted that there is land dispute between both sides, there is no specific overt act against petitioner No. 1 who is alleged to be member of the mob only, both petitioners are not said to have assaulted the deceased; the allegation of assault attributed to petitioner No. 2 is to one Ram Babu Singh causing injury on his right hand. It is further submitted that petitioner No. 1 had instituted a case under Section 307 IPC against the present informant few months prior to the present occurrence therefore to put pressure they

Patna High Court Cr.Misc. No.15636 of 2018 (2) dt.21-03-2018 have been implicated in this case, both the petitioners have no criminal antecedent and they are in custody since 29.10.2017. Having considered the said facts and circumstances, the petitioners, namely, Ravindra Singh and Birendra Singh are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst (West) Muzaffarpur in connection with Sahebganj PS Case No. 302 of 2017.
