====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 18-04-2024 Heard learned counsel for the petitioners and learned APP for the State.

2. Petitioners apprehend their arrest in connection with Gaurichak P.S. Case No. 629 of 2023, registered for the offence punishable u/s 365, 341, 323, 506, 34 of the IPC, pending in the court of learned A.C.J.M.-VI, Patna City. Later on, Section 302/201 of the Indian Penal Code was added.

3. After some arguments, learned counsel for the petitioners seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as

Patna High Court CR. MISC. No.15409 of 2024(3) dt.18-04-2024 2/2 withdrawn.

6. However, if petitioners surrender before the learned Court below within six weeks from today and seek regular bail, the learned Court below shall pass order on the same day in accordance with law without being prejudiced by this order considering the fact that there is no eye-witness of the alleged occurrence and the name of the petitioner has been transpired in the present case merely on suspicion.
