The petitioner apprehends his arrest in connection with Naya Ramnagar P.S. Case no. 214 of 2015 registered under Sections 147, 148, 149 and 307of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is that the informant along with three others had gone to plough his filed at that time petitioner along with his brother Pawan Yadav, cousin Narad Yadav along with 2-3 unknown reached there and started firing indiscriminately. Learned counsel for the petitioner submits that, in fact, the land in question was purchased by the petitioner in the year 1993 and the same was cultivated by the petitioner, due to obstruction created by the informant, on the basis of written report of the informant, Officer-in-Charge of Naya Ramnagar P.S. made request to
Patna High Court Cr.Misc. No.9661 of 2016 (3) dt.26-04-2016 2/2 S.D.O Sadar, Munger through non F.I.R. No. 15 of 2015, dated 02.04.2015 to institute case under Section 107 of the Cr.P.C. Moreover, no injury has been sustained by the informant. The petitioner having no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Munger in connection with Naya Ramnagar P.S. Case No. 214 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
