JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-03-2015 Petitioner is languishing in custody since 15.12.2014 in a case registered for the offences punishable under Sections 406, 420/34 of the I.P.C.
It is alleged that rupees sixty thousand was taken by the accused persons on promise to return with good interest but neither interest was given nor principal amount was returned.
It is submitted by learned counsel for the petitioner that First Information Report suggests that money was given to Mamta Devi though there is not proof with regard to the payment.
It is submitted by learned counsel for the informant that petitioner also accompanied Mamta Devi while she went to receive money and he counted the money after the money was received by Mamta Devi.
Patna High Court Cr.Misc. No.10685 of 2015 (2) dt.23-03-2015 2/2 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the nature of accusation and the petitioner having no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Katihar in connection with Kodwa P.S. Case No. 176 of 2014.
