JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-03-2016 Petitioners being parents and brother of the husband of the daughter of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 498A, 365/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The prosecution case is of inflicting torture to the daughter of the informant for non-fulfilment of dowry demand and kidnapping her.
It is submitted by learned counsel for the petitioners that daughter of the informant went to her parents house and now she is residing with her husband. It is further submitted that thrust of accusation is against the husband of the daughter of the informant. It is also submitted that petitioners will persuade the husband of the daughter of the informant to produce her wife before learned court below.
Patna High Court Cr.Misc. No.10627 of 2016 (2) dt.03-03-2016 2/2 Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for three months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West, Muzaffarpur in connection with Kanti P.S. Case No. 605 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The provisional bail of the petitioners will be confirmed by learned Court below after production of the daughter of the informant by her husband.
